Anthropic broke the law by using pirated books to train its AI and agrees to create $1.5 billion fund to compensate authors

AI company Anthropic has agreed to create a $1.5 billion fund to compensate authors whose works it used to train its models without permission.

The fund is part of a proposed settlement for a legal case filed in California by three authors who claimed that Anthropic used their works to train its models without seeking or securing permission.

Anthropic PBC is an American artificial intelligence ("AI") startup company founded in 2021 by former members of OpenAI, including siblings Daniela Amodei and Dario Amodei. In a previous article, we noted that Dario Amodei was named by CNN in August as one of the 12 new billionaires that AI has created. As the following story demonstrates, behind every billionaire is a crime.

Last week, Anthropic agreed to settle a case brought against the company by three authors who claimed that Anthropic illegally used their works.

Anthoropic admitted to buying and digitising millions of physical books, as well as downloading millions of pirated books from websites such as Library Genesis and Pirate Library Mirror, which led to the lawsuit claiming illegal use of the authors' works.

Anthropic won part of the case; the court ruled that scanning books is fair use and using them to create transformative works is acceptable. However, the company was found to have broken the law by knowingly ingesting pirated books.

Under the proposed settlement, Anthropic will create a $1.5 billion fund which values each pirated book it used for training its models at $3,000. Anthropic has also agreed to destroy the pirated works.

In court documents, counsel described this as the largest ever copyright recovery claim to succeed in the USA.
