The modern "birthright citizenship" has been...

Editor's note: ...stretched far beyond the original intent of the Fourteenth Amendment, effectively incentivizing illegal immigration through so-called "anchor babies." The phrase "subject to the jurisdiction thereof" was meant to exclude those without full political allegiance, such as temporary or unlawful migrants, meaning their children were never intended to automatically receive citizenship. Therefore, ending this practice does not necessarily require a constitutional amendment, but rather a stricter, originalist reinterpretation of existing law by courts or policymakers. Birthright citizenship, as currently applied, is a policy choice, not a constitutional inevitability, and could be curtailed through reinterpretation rather than having to rewrite the Constitution.
