SUBJ: CHARGES OF FEDERAL CRIMINAL VIOLATIONS INVOLVING MANSLAUGHTER OF AIRLINE PASSENGERS AND AIRCREW MEMBERS THROUGH AIRLINE EMPLOYEE WHISTLEBLOWER SUPPRESSION IN THE UNITED STATES BY GOVERNMENT AGENCIES AND CIVIL EMPLOYEES


Honorable Gentlemen,



I write to your good offices today regarding grave matters concerning suppression of airline employee whistleblowers, which I herein accuse the guilty parties of alleged manslaughter of passengers and aircrew members as a result of said activity. I have evidence and witnesses who will support these serious allegations involving commercial airline senior-level managers, government officials of the Department of Transportation, and certain members of the Air Line Pilots Association, the union representing over 50,000 airline pilots on the North American continent.

As you know, the Atlanta office of the Securities and Exchange Commission is currently investigating my 2007 Sarbanes-Oxley allegations of alleged fraud in the United Airlines post-9/11 bankruptcy. In July 2010, I filed a federal complaint with the Atlanta office of the Federal Bureau of Investigation concerning these and other serious allegations in this case, which includes purported suppression of my federally-mandated Aviation Safety Awareness reports and other related violations of federal RICO laws. There are available witnesses, informants, and criminal evidence available regarding these matters as well.

This week I will be forwarding to the Atlanta offices of the Securities and Exchange Commission and the Federal Bureau of Investigation a comprehensive signed and sworn affidavit detailing all events in my life from September 11, 2001 to present as a former United Airlines B-777 captain. Included in this evidence package will be copies of digitally-recorded 2003 phone conversations between key United Airlines management personnel and myself, as well as copies of court transcripts obtained of sworn testimony by me under oath in a federal court of law before Atlanta Judge F. Jefferson Hughes on July 23, 2008 concerning another matter relevant to this case.

Recognizing that there are federal and state laws that limit an individual from recording phone conversations without prior knowledge and consent of the other party, the phone conversations described above did not, to the best of my knowledge and through legal advisement of my attorneys at the time, violate these laws because of the geographic location of the parties involved in these conversations. If I unknowingly have, in fact, violated a state law in some regard, then I will accept full responsibility for these actions. Human lives were at stake at the time and my actions were in full support of the Federal Aviation Administration and Department of Homeland Security mission statements and the Air Line Pilots Association Code of Ethics.

The members of the grassroots Whistleblowing Airline Employees Association are currently working in close concert with such advocacy groups as the Government Accountability Project, the Project on Government Oversight, the National Whistleblower Center all in DC, and the grassroots groups FlyersRights.org, FAA Whistleblowers Alliance, Medical Whistleblower, United States Coalition of National Security Whistleblowers of America, Transportation Security Administration Whistleblowers Coalition, Forensic Fraud, Inc., Whistleblowers Press Agency in the United Kingdom, the Federal Accountability Initiative for reform in Canada, and many other national and global whistleblower and media organizations to expose these issues.

Kate Hanni, the executive director of FlyersRights.org is currently in consultation with Ralph Nader and his organization, as the safety and security issues stated above are concerns of both airline travelers and consumers alike and must be addressed by our government in a federal court of law.

Dr. Janet Parker, executive director of Medical Whistleblower, just recently appeared as a guest on our Whistleblowing Airline Employees Blog Talk Radio Program to advise us of recent personal phone conversations with President Obama concerning human rights violations that will be addressed in Geneva, Switzerland on November 22, 2010 concerning these very issues of abuse of human rights in our country that allegedly is in violation of Geneva accords regarding the same. I currently serve as Dr. Parker’s Transportation Whistleblower in her organization and my concerns will be addressed in several days before the United Nations.

I attempted to report these issues as a witness at the Colgan Air 3407 hearing held by Senator Dorgan on Capitol Hill on June 17, 2009, but was only permitted to provide an evidence package that contained a signed and sworn affidavit that is currently on file as part of congressional public record for that hearing and has been included as evidence in the ongoing United Airlines investigation in Atlanta, Georgia.

Please be advised that President Obama and many other members of the Department of Justice and other branches of government have been fully aware of the details surrounding my personal case as early as 2006. And yet, I recently received a personal letter from Department of Transportation Assistant Inspector General Robert Westbrooks advising me that my case had been closed by their office. It is not.

NSA whistleblower Russell Tice lost his security clearance as a result of an alleged retaliatorial ‘hostile work environment forced psychiatric evaluations’.

United States Marine Corp whistleblower Franz Gayl just lost his security clearance for being honest in his attempt to protect armed servicemen in harm’s way in foreign lands as was just reported in the Washington Post Article, “Marine Whistleblower Franz Gayl: Security Clearance Removal Is Retaliation”.

These individuals were employees of the federal government who were required to maintain a security clearance to continue employment in their capacity in service and security protection for the citizens and soldiers of our country and exercised their first amendment freedom of speech rights as provided by our sacred constitution.

Airline pilots require federally-issued pilot licenses and medical certificates to fly commercial jet aircraft, but are not federal employees. There have been many honest airline pilot whistleblowers past and present that have lost their FAA medical certificates through alleged employment of ‘hostile work environment forced medical and/or psychiatric evaluations’.

These individuals are the front-line employees in commercial aviation that serve as the one-way check valve in reporting safety and security issues to appropriate authorities within the Federal Aviation Administration and the Department of Transportation under the captain’s authority vested in them by Federal Aviation Regulations and federal laws.

If a commercial airline pilot fails to report alleged flagrant violations of federal laws that include RICO violations, then he is guilty of misprision of felony under 18 U.S.C. § 4:

“Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.”

As a patriotic U.S. citizen and a pilot for 35 years, I herein charge certain members of the Department of Transportation, the Federal Aviation Administration, United Airlines management, and the Air Line Pilots Association with alleged manslaughter, misprision of felony, and obstruction of federal justice in issues concerning my case. I respectfully demand that this letter be included in my record associated with my filed federal complaint made to the FBI intake agent on duty on July 20, 2010. I have witnesses who will attest that I filed this report and confirmed the existence of this file in the FBI computer with another FBI Intake agent on duty the following week.

Additionally, it is respectfully requested that Mr. Matthew McNamara, the assistant director of the Atlanta office of the Securities and Exchange Commission retain this letter in his file concerning his investigation of my allegations. I was advised via email in May 2010 by Ms. Debbie Hampton, the senior attorney in this case, that Mr. McNamara would be my direct point-of-contact on matters pertaining to this investigation.

Since the Department of Transportation Inspector General closed my case without reviewing available evidence or questioning witnesses in my case, I will join other airline pilots with supporting documented evidence backed by case law provided in the case of former Delta Airlines Captain Wayne Witter whose case history will provide conclusive evidence of employment of psychiatric evaluations used to medically ground honest pilot whistleblowers.

The airline traveling court of public opinion will judge harshly those criminals complicit in this horrific practice of retaliatory action against front-line airline employees who were only looking out for their safety and security while on board commercial jet aircraft. Since our government will not respond to these allegations through investigations and our mainstream media has failed for the most part in reporting these same assertions, then perhaps the United Nations and the rest of the free world will support our noble cause.

Our stories will be told and justice will be served in accordance with the precepts of the United States Constitution. Although our association is in full support of passage of the Whistleblower Protection Enhancement Act that will add protection for federal employee whistleblowers, since pilots and others within the airline industry are not federal employees per se, our intent is to seek due process of law by any and all legal means available. Failure of passage of this legislation will not preclude members of our association from exercising free speech and seeking justice in our cases.

There are individuals and organizations closely working behind the scenes to expose this travesty of justice and many across the globe are already in receipt of the above mentioned recorded phone conversations and court transcripts. Our website, Whistleblowing Airline Employees Association, has been read and many pages downloaded in over 100 countries across the planet. Many who are studying the materials on our website are employees of countless airlines in every nation in the world.

In the end, truth, justice, and the American way will prevail.

The special interests of the Whistleblowing Airline Employees Association are the millions who travel by commercial air and not the interests of Wall Street bankers and the K-Street lobbyist who represent their ‘special interests’ and stock portfolios.
